RAL22/0028 APPLICATION FOR RECONFIGURING A LOT (1 INTO 2 LOTS) AT 1 POINCIANA AVENUE, TEWANTIN (REFERRED FROM P&E 9 MAY 2023)
Executive summary
This report provides an assessment of an application to reconfigure an existing 1169m2 lot into 2 residential lots, with lot 1 to have an area of 600m2 and lot 2 an area of 576m2. The site is zoned Low Density Residential and is located on the corner of Poinciana Avenue and Butler Street, Tewantin, adjacent a busy round about. A sewer line runs adjacent the site’s southern boundary. The applicant proposes to demolish the existing building with the existing access arrangements for lot 1 maintained – entering from Poinciana Avenue and exiting to Butler Street and a new access proposed for Lot 2 from Butler Street. The assessment concludes that the proposal does not meet the Reconfiguring a Lot Code requirements falling below the minimum lot size and lot width and/or being irregular in shape. While the lot size is generally consistent with other lots in the area, the proposed subdivision will not result in suitable house sites for future residents and an appropriate, safe access is not able to be provided for both lots. It is also expected that access to lot 2 will adversely impact on the functionality of the roundabout given its proximity to the roundabout. Creating additional lots on a roundabout is not desirable from both a traffic and amenity perspective. The application is therefore recommended for refusal.
Recommendation
That Council note the report by the Acting Manager Development Assessment to the Planning & Environment Committee Meeting dated 9 May 2023 regarding Application No. RAL22/0028 for a Development Permit for Reconfiguring a Lot – 1 into 2 lots, situated at 1 Poinciana Ave Tewantin and:
- Refuse the application for the following reasons: 1. The proposal does not comply with Overall Outcomes 2(a),(e)(ii), Performance Outcomes PO5(a),(c),(e), PO6(b),(d), PO13,PO20(c),(d),(f) and Acceptable Outcomes AO5.1, AO5.2, AO13.1, AO20(e),(h) of the Reconfiguring a Lot Code as: a. The proposed lots do not comply with the minimum lot size and average width and/or are irregular in shape and are not suitable to accommodate future dwellings. b. The proposed lots cannot accommodate future dwellings consistent with the purpose and overall outcomes of the Low Density Residential Zone as the proposed lots will not make a positive contribution to the streetscape or achieve a high level of residential amenity for future residents. c. An appropriate safe and convenient access is not able to be provided to each of the lots, with the proposed new access likely to adversely impact on the functionality of the road network. d. The proposed lots are located adjacent a roundabout and are not appropriate from a traffic safety and amenity perspective. 2. The proposal does not comply with Overall Outcome 2(i) and Performance Outcome PO3 of the Transport Code as the proposed new access is not appropriate and is likely adversely impact on the safety and operation of the road system.
