MCU24/0084 MATERIAL CHANGE OF USE - FUNCTION FACILITY – 658 LOUIS BAZZO DRIVE, RINGTAIL CREEK
Executive summary
This application is for a material change of use of premises for a function facility for the purpose of holding small scale functions, weddings and events. The use is proposed to operate between 11.00am to 10:30pm and cater for a total of a maximum of 150 guests. The site is zoned Rural under the planning scheme and is currently operating as a macadamia farm. A function facility is a consistent use under the Rural zone. The existing macadamia farm will continue to operate in conjunction with the proposed use. The proposal involves establishing a permanent marquee (300m2), with a canapes terrace (221m2) and cocktails terrace (287m2) with associated car parking and manoeuvring areas adjacent to an existing waterbody. A total of 50 car parks are to be provided in addition to 2 coach/bus parking spaces. The applicant advises that the proposed function facility is intended to be undertaken in accordance with an approved Operational management plan. The key operational features of the proposed function facility are as follows: • Max. events a year – 96 • Max. guests 150 (average guests 80-100 persons) • 70-80% of guests to be chauffeured to an event i.e. 2 bus trips. • Hours of operation 11am to 10.30pm Monday to Sunday. All buses and vehicles to leave the site by 11.00pm The following table (Table 1) - provides an overview of schedule of events for the calendar year. The primary issues associated with the development are land use, noise, traffic and the protection of the site’s environmental values. The proposed use as a function facility is a consistent land use in the Rural Zone under the Noosa Plan 2020. An Environmental Noise Level Impact Assessment was submitted and peer reviewed in support of the proposed development. The recommendations from the report have been conditioned to ensure the proposed use operates in accordance with the relevant noise criteria. Traffic impacts have been addressed through an RPEQ certified Traffic Engineering Report and the State Assessment and Assessment and Referral Agency has conditioned upgrades to Louis Bazzo Drive, which is a State controlled road. The access has been conditioned by Council’s Engineers to be sealed. It is recommended that the site’s environmental values are protected through environmental covenants. Environmental impacts have also been addressed in the submitted Ecological Report and Stormwater Management Plan. The application material, and associated reviews, have demonstrated that the use can occur on-site with potential amenity impacts being mitigated through implementation of the recommendations of the associated management plans and/or conditions. It is recommended that the application be approved.
Recommendation
That Council note the report by the Development Planner, to the Planning & Environment Committee Meeting dated 10 December 2024 regarding Application No. MCU24/0084 for a Development Permit for Material Change of Use - Function facility situated at 658 Louis Bazzo Drive Ringtail Creek Qld 4565 and:
- Approve the application in accordance with the proposed conditions outlined in Attachment 1; and
- Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.
