Executive summary

This report reviews an application to reconfigure a residential lot into 2 lots and create an access easement over the existing driveway to create a shared access. The site is zoned Low Density Residential under the Noosa Plan 2020 and is mapped as having vegetation of biodiversity significance and being subject to flooding generally along the site’s eastern and southern boundaries. The site and adjoining Heritage Park are also mapped as having a high potential bushfire intensity. The proposed lots are consistent with the applicable codes except for Performance outcome PO4 of the Reconfiguring a Lot Code which requires that no additional lots are created with access to Griffith Avenue. In this regard Council’s Strategic Planning Team have advised this provision was included in the Noosa Plan 2020 to protect the character of Noosa Parklands which included larger residential lots. It is however since recognised that there are very limited opportunities for further subdivision in this older estate where subdivision can occur and for this reason further subdivision such as the proposed is not likely to impact the area’s character. The site’s biodiversity values, flooding and potential bushfire risks (as detailed in the report) can be appropriately managed within each proposed allotment without increasing the risk to people or property or comprising existing ecological linkages. The subdivision of land is recommended for approval subject to conditions.

Recommendation

That Council note the report by the Development Planner to the Planning & Environment Committee Meeting dated 6 February 2024 regarding Application No. RAL23/0015 for a Development Permit for Reconfiguring a Lot – 1 lot into 2 lots and Access Easement situated at 11 Billabong Way Tewantin and:

  1. Approve the application in accordance with the proposed conditions outlined in Attachment 1.
  2. Include the following Property Notes on the approved lots: Lot 1
  3. During inclement weather events up to and beyond the 1% AEP event, this lot experiences flooding along the eastern and southern property boundaries.
  4. All structures are to be constructed within the building envelope shown on the approved plan. For more information refer to Council Approval RAL23/0015.
  5. To ensure the safety of people and property on this property is maintained, all buildings and structures must be sited constructed in accordance with the bushfire management conditions of Council Approval RAL23/0015. Lot 2
  6. During inclement weather events up to and beyond the 1% AEP event, this lot experiences flooding along the eastern property boundary.
  7. All structures are to be constructed within the building envelope shown on the approved plan. For more information refer to Council Approval RAL23/0015.
  8. To ensure the safety of people and property on this property is maintained, all buildings and structures must be sited constructed in accordance with the bushfire management conditions of Council Approval RAL23/0015.
  9. Include the following Reference Document: Plan No. Rev. Plan/Document Name Date - 1 Bushfire Evacuation Plan prepared 13.11.2023 by Equilibrium Ecology
