Executive summary

This report provides an assessment of an application for a minor change to an existing development approval for a Home based business (meat processing facility) at 82 Patterson Drive, Tinbeerwah. The applicant seeks to change the approval to: • Delete condition 6 which states no employees are permitted; • Amend condition 10 to allow 2 employees at the site between the hours of 8 am to 4pm Monday to Friday to assist with the day to day processing of deer; and • Delete condition 21 which requires the applicant to reapply to Council, to extend the currency of the approval. No other changes to the operations of the use are proposed. The proposed deletion of condition 6 and change to condition 10 to allow 2 employees is consistent with the Home-based Business Code and will not impact the surrounding residential amenity. The proposed changes do not alter the hours or operation or capacity of the use with the processing of wild game (venison) still to remain at a maximum of 1 evening a week and processing a maximum of 10 carcases a week. The assessment concludes that allowing two additional employees at the site is in keeping with the intent of the Home Based business code and will improve the day to day efficiency of the business. The applicants request for the deletion of condition 21 relating to the lapsing date for the approval is not supported as the condition will enable the changes to the use to be monitored to ensure that the changes do not impact on the surrounding area. The condition is recommended to be amended to require an extension of the permit date after four years. The proposal is therefore recommended for approval.

Recommendation

That Council note the report by the Senior Planner to the Planning and Environment Meeting dated 11 February 2025 regarding Application No. MCU21/0154.02 for a minor change to the development approval for a Home-based business (Meat Processing Facility) situated at 82 Patterson Drive, Tinbeerwah and:

  1. Approve the application and agree to change condition 10 outlined in Attachment 1.
  2. Refuse the request to delete Condition 21, instead changing the condition as outlined in Attachment 1.
  3. Delete condition 6.
  4. Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.
