CONTRACT NO. CN00311 - FLOOD RECONSTRUCTION - GOLDEN GULLY ROAD - CULVERT REPLACEMENTS
Executive summary
• This report provides a tender evaluation summary and recommendation for the tender award for the reconstruction of sites along Golden Gully Road, Kin Kin which were impacted by the February/March 2022 Flood. • The sites are two (2) floodways which extend across the road nearby property numbers #87 and #116. These have sustained extensive damage which undermines the existing structures spanning the waterways. There is also a smaller scour to a concrete road section. • The sites are eligible structures under the Reconstruction of Essential Public Assets (REPA) and funded under the Disaster Reconstruction Funding Arrangements (DRFA) administered by THE Queensland Reconstruction Authority (QRA) using funds from both state and federal governments. • In accordance with Council procurement policy and procedure, an Invitation to Tender (ITT) was initiated and attracted eight (8) companies to the site briefing. At tender box close on 20 March 2023 four (4) tender submissions were received with two (2) considered compliant for further assessment. • Following a detailed assessment by the evaluation panel it is proposed to award the contract. • The tender evaluation panel completed the evaluation process and considered the tender from Sunshine Civil Solutions Pty Ltd to be the most advantageous to Council, presenting the best value for money. • The reconstruction is funded by the Queensland Reconstruction Authority (QRA) using funds from both state and federal governments. The sites are eligible structures under the Reconstruction of Essential Public Assets (REPA) and funded under the Disaster Reconstruction Funding Arrangements (DRFA) grant.
Recommendation
That Council note the report by the Disaster Reconstruction Coordinator to the General Committee Meeting dated 17 April 2023, and:
- Award Contract No. CN00311 for Golden Gully Road Culvert Replacements to Sunshine Civil Solutions Pty Ltd for a lump sum price of $1,190,773 (excluding GST);
- Authorise the CEO to negotiate the final contract with Sunshine Civil Solutions Pty Ltd.

61.5 Note: Further costs for preliminary and project management brings to total to $80m The scope issued by Council was created by Erscon Engineering Consultants based on the applicable grant funding guidelines allowing for the sites to be returned to functional use. In this instance, the two (2) water crossings are amber fish passageways, so the sites need to be upgraded to meet latest Department of Agricultural and Fisheries design standards. This involves replacing pipes and upgrading them to box culverts. The design requires some treatment on the embankment. Erscon have recommended for Queensland Reconstruction Authority (QRA) to accept a wingwall design (Cast-in-situ concrete wall to help stabilise the banks of the creek) in lieu of turf to stabilise. Council are currently liaising with QRA to cover the cost of the wingwalls which is approximately $34,000. If this funding is not agreed to by the time this work needs to be executed, a Contract variation shall be required, reverting the design to turf. This leaves Council with no exposure of cost to budget.
Tender Process The original estimation of work was to be higher than $200,000 so the work was tendered in accordance with the Local Government Act 2009 and Council’s Procurement Policy. The Invitation to Tender (ITT) for CN00311 was released via VendorPanel on 21 February 2023. The ITT nominated a mandatory site meeting which eight (8) companies attended. At the site meeting, contractors identified that material sourcing may become an issue, so Council issued a Notice to Tender offering an alternative to Cast-in-situ. The Response Closing Date was 13th March 2023 at 10.00am. Respondents requested an extension to submit bids. Council agreed to a further extension of one (1) week adjusting the Response Closing Date to 20th March 2023.
Tender Evaluation Four (4) responses were received within the VendorPanel e-portal, of which two (2) were conforming listed below in alphabetical order: • Civilec T/A GRC Civil Pty Ltd; • Sunshine Civil Solutions Pty Ltd The conforming tenderers were then evaluated using Council’s Weighted Attribute Evaluation spreadsheet against the following evaluation criteria and weightings: Evaluation Criteria Weighting (%) Price 30% Contribution to Local Economy 5% Experience and Technical Capability - Contract Experience and Key Resources 20% Experience and Technical Capability - Commitments and Capacity 10% Management Systems – Work Health and Safety 5% Management Systems – Environmental and Sustainability 5% Management Systems – Quality Management 5% Methodology – Delivery of Scope 10% Methodology – Project Schedule 10% The evaluation was conducted by the Evaluation Panel consisting of the following members of staff: Position (Title) Contract Administrator (Contractor - Reconstruction Works) Contractor (Reconstruction Works) Erscon Consulting Engineers - Engineering Consultant Infrastructure Delivery Coordinator Contract & Projects Superintendent Workplace Health & Safety Adviser Principal Environment Officer – Environment Planning (Land) Project Officer - Carbon Reduction Each member of the Evaluation Panel read and declared that they understood and accepted the probity requirements, which includes a declaration of conflicts of interest and confidentiality. The lowest priced submission was tendered by Sunshine Civil Solutions Pty Ltd, at the lump sum price of $1,190,773 (excluding GST). This is 2.6% lower than the other conforming tender submission from Civilec T/A GRC Civil Pty Ltd. The tender evaluation panel completed the evaluation process and considered Sunshine Civil Solutions Pty Ltd to provide a better value for money solution. The evaluation panel identified that they were more favourable in the following areas: • Scored highest for non-price criteria and combined price and non-price criteria; • Provided full compliance of tender requirements; • Demonstrated key personnel and subcontractors with applicable experience in similar projects; • Proposed methodology demonstrated an understanding of the scope and the impact to the community; • Detailed environmental and sustainability approach; and • High contribution to the local economy with the business based in Noosa. The Evaluation Spreadsheet (Attachment 1) presents the evaluation outcome of the conforming submissions against the above criteria.
Next Steps
The next step will be to award the contract to Sunshine Civil Solutions for a value of $1,190,773 (excluding GST) which is funded by a Queensland Reconstruction Authority grant.
